Abstract

Clhub.art is a digital space for professionals and companies to access collaborations between local artistic hubs and creative minds.
Clhub.art aims to provide a SaaS enabled marketplace to enable the exhibition process of artworks and the purchase process of artworks and artistic performances.
Clhub.art is a network of art enthusiasts, artists and businesses playing the role of exhibitors. By registering to Club.art's platform, members agree to the following terms and conditions. In the case of non-compliance of the terms and conditions, Clhub.art reserves the right to bring exhibitions to an end without any refund of charges at any stage of the process.

The following general Terms and Conditions apply to all services provided by the internet Website www.clhub.art (hereafter referred to as “Clhub.art” or “the Website”).
The present terms and conditions apply exclusively to businesses, as defined in §§ 14, para. 310 of the German Civil Code. Clhub.art is an Internet marketplace for creatives (artists), event organisers (promoters), booking agencies, labels, publishers and other industry stakeholders in the creative sector (herein referred to individually as "the User" and collectively as “the Users”).
Clhub.art is available to Users registered on the Website.
Users can use the Website as themselves, or represent third parties.
They can communicate with each other using the Website’s infrastructure and/or conclude and manage contracts, such as agreements concerning specific performances (gigs, performance slots, events, shows, exhibitions etc.), or contracts governing marketing and sales services.
By registering with Clhub.art, the User agrees to the following General Terms and Conditions (hereinafter "GTC"), which form part of a contract between the User and Clhub.art (represented by Alessandra Speranza based in Barcelona, Spain and Giuseppe Muto based in Berlin, Germany) concerning the use of the Website by the User ("User Agreement").
The present GTC also applies to the use of any services provided by Clhub.art free of charge ("CLHUB.ART FREE").
For the use of additional services against payment, namely products or service packages such as CREATOR, CREATOR PRO, CREATOR PLUS etc. (collectively referred to as "CLHUB.ART PREMIUM" products and/or services), the User needs to conclude additional, separate User Agreements. The present GTC shall also apply to any and all CLHUB.ART PREMIUM User Agreements, which shall supplement the User's underlying CLHUB.ART FREE User Agreement, and which can be terminated separately.

1. Scope

1.1. The present Terms and Conditions apply to all Users of clhub.art. Modifications and additions to the present Terms and Conditions shall only apply if they have been agreed upon in writing and signed by the User and Clhub.art. The present Terms and Conditions apply to the use of all Clhub.art services and products, regardless of whether they are provided free of charge or against payment.

1.2. Clhub.art reserves the right to change these Terms and Conditions at any time and without notice. Any modified or updated terms and conditions will be sent to the User by email at least 1 week before they become effective. If the User does not object to the changed terms and conditions by email within 1 week, they are deemed accepted. Should the User object to the amended GTC, Clhub.art can block the User's account on the Website. Clhub.art will specifically outline the potential legal consequences of an objection in the email accompanying the amended Terms and Conditions.

1.3. For the purposes of the present Terms and Conditions:
a. An "Account" belongs to a specific User. The User first creates a Log-in and sets up at least one profile, either in their own name as a natural person, or as a representative of an organisation, a company, an institution, etc. An Account allows the User to set up several profiles, to contact other Users on behalf of these profiles, and to negotiate and conclude agreements with them;

b. A "Log-in" provides access to the Website. It is created by the registration and sign-in of a natural person on www.clhub.art, and results in assigning an Account to the User;

c. A "Profile" is a representation of an industry actor (creator, business, hub, label, promoter, etc.) created by a User for the purposes of promotion on a "Profile Page", "Creator Page", “Hub Page” created and managed on the Website by the User.

d. "Registration" refers to the creation, by the User, of a Log-in and of one or more Profiles. It includes the User's access to Clhub.art FREE services;e. A "User" is a natural or legal person, or an association of persons from the B2B sector, registered with Clhub.art.

2. Registration

2.1. In order to register as a User on Clhub.art, a natural person must first create a Log-in and accept the present Terms and Conditions. Children under the age of 18 but over the age of 14 may register on the Website only if they obtain the express consent of their legal guardians. Children under the age of 14 are not allowed to register as Users of the Website. Any personal data required for creating a Log-in are stored in the User Account and can be accessed by the User at any time. Personal data will not be published on the Website or communicated in any open call applications; the only information to be communicated will be the User's name and location.

2.2. The User may create a Profile under their own name. As the owner of an Account, the User may manage any profiles associated with or assigned to that Account.

2.3. The User may also create Profiles in someone else's name, or assign a Profile to a different Account, under the following conditions:
a. Creation of profiles under different names by the administrator of an Account: Users over the age of 18 may create unlimited profiles. Any User registering as an Administrator for a legal person, such as an association, company or an institution, hereby ensures Clhub.art that they are authorised to represent the legal person(s) in question. A Profile is only created when Clhub.art approves the conclusion of the User Agreement. Clhub.art informs the User via email about it.

b. Profile assignment: Profiles may be assigned to, or associated with multiple Accounts, following User approval. This feature will be announced by Clhub.art when available.

3. Clhub.art FREE User Agreement

3.1. The Registration on, and use of the Website are free of charge; however, Clhub.art FREE does not allow Users unlimited access to the full range of services provided on the Website. A successful Log-in or the creation of a Profile by the User merely represents an offer to conclude a User Agreement regarding the use of Clhub.art FREE or, where applicable, of Clhub.art PREMIUM services. Clhub.art reserves the right to accept or reject this offer. The conclusion of a User Agreement lies at Clhub.art's discretion; the User does not have a right to demand the conclusion of a User Agreement with Clhub.art.

3.2. Once the User has created a Log-in and set up their first Profile, Clhub.art will confirm the conclusion of a Clhub.art FREE or Clhub.art PREMIUM User Agreement by contacting the User at the email address provided by the latter. The confirmation email will activate the above-mentioned User Agreement. Should the User choose to sign up for Clhub.art PREMIUM services at a later stage, having already completed the registration process for Clhub.art FREE, the same confirmation process shall apply. The Clhub.art PREMIUM User Agreement shall be activated upon reception of a confirmation email by Clhub.art. When concluding a User Agreement with Clhub.art, the User shall not require a notification of acceptance, in accordance with §151 of the German Civil Code.

3.3. The User is responsible for all actions carried out through their Account and all associated Profiles. The User must provide truthful and complete information, in particular with regard to the age and identity of the natural person associated with a User Profile.

3.4. Should the misuse of a Log-in Account or a User Profile be due to the negligent or intentional actions of a User, said User shall be liable for any damages incurred. The User accesses and uses the Website at their own risk. This applies in particular to the use of any content downloaded from or otherwise provided by the Website or other Website users. The User must keep all Log-in information confidential. As soon as the User becomes aware of unauthorized access to their Log-in information by third parties, they must inform Clhub.art without undue delay. This also applies to any other misuse of the Account that the User may become aware of.

3.5. The User may not engage in any illegal activity while using the Website. In particular, the User may not:
a. Save, publish and/or transmit content (such as statements, information, images, or other data) or external links that violate the rights of third parties, or any content that is unlawful, immoral, harassing, insulting, obscene, pornographic, violent, youth-endangering, racist and/or discriminatory, or otherwise inappropriate;

b. Collect, copy, distribute, or use the content or data stored on the platform by other users without their prior explicit consent;

c. Harass, threaten, insult, slander, discriminate based on sex, race, religion or other beliefs, or knowingly disseminate information that is untrue;

d. Provide links to third-party content that violates these Terms and Conditions or any other legal provisions;

e. Communicate their or any other User's Log-in information to unauthorized third parties;

f. Use the Website for illegal advertising or marketing.

4. Profile Creation and Usage

4.1. When creating a Profile, Users must submit personal information, some of which may be required as mandatory for the creation of the Profile. Users will be asked to submit such information when creating their Profile, and may edit or modify that information at any time. All mandatory information is indicated by an asterisk. The Profile contains all essential information regarding the User. The information contained on the Profile will not be disclosed beyond the Website. That information may be used for various purposes, including for optimally connecting Users on the Website. Clhub.art bears no responsibility for the true identity of the persons behind the individual Profiles, as it does not verify that information.

4.2. Users can create and customise their presence on the Website (for example, by creating an artist page, or a hub page). For that purpose, certain information may be extracted from the User's Profile, including the name of the User's authorised representative. Users may also add their own content and provide additional information. Microsites, artist pages and promoter pages serve as electronic press kits (EPK): they ensure the easily accessible, clear and comprehensive representation of the User in all business transactions.

5. Collection of Data

5.1. All processing of personal data is carried out in compliance with the relevant data protection provisions, in particular the GDPR.

5.2. Clhub.art has the right to collect, process and use any data provided by the User, as well as any data collected in connection with the User's use of the service, in compliance with all applicable legal provisions, insofar as this is necessary for the smooth functioning of the Website and/or required for the processing and management of contractual relationships. Clhub.art also has the right to save content and transmit such content to third parties, insofar as this is required by law or necessary and legally permissible, after due consideration.

6. External Links

The Website contains links to other websites. Clhub.art has no control or influence over the content and design of any such website. Any responsibility for the content of linked pages lies with the providers or operators of such pages. As soon as it becomes aware of any legal violations, Clhub.art will immediately check such links and, if necessary, remove them.

7. Third Party Services

7.1. Certain aspects of our Services are provided through integration with servicesprovided by parties other than Clhub.art (the Third Party Service or Third Party Services).

7.2. For accepting card payments we provide access to Stripe Connect, operated by Stripe, Inc. of the United States (Stripe).

7.3. In order to use the Third Party Services, a User will be required to authenticate with the Third Party Service and agree to that service providing us with certain information in relation to them, such as the User’s name and email address. We will use, store and disclose information provided to us by a Third Party Service, and you consent to our use of such information, in accordance with our Privacy Policy.

7.4. We provide access to Third Party Services for the convenience of our Users, and the integration or inclusion of such services does not imply an endorsement or recommendation by us.The Website contains links to other websites. Clhub.art has no control or influence over the content and design of any such website. Any responsibility for the content of linked pages lies with the providers or operators of such pages. As soon as it becomes aware of any legal violations, Clhub.art will immediately check such links and, if necessary, remove them.

8. Liability and Limitation of Liability

8.1. Clhub.art bears no responsibility for the relevance, correctness, completeness or quality of any information provided by Users of the Website.

8.2. Clhub.art works hard to make the Website fully available, but cannot guarantee it at all times. Maintenance, security or capacity issues, as well as events that are not within Clhub.art's control (such as power failures, etc.) may lead to brief interruptions to the services provided by Clhub.art.

8.3. The aforementioned exclusions and limitations of liability do not apply to any damage resulting from injury to life, limb of health, or to the fraudulent concealment of defects by Clhub.art, or in the case of product liability claims.

8.4. Any claims for damages against Clhub.art come under a statute of limitations of 3 months from the time when the claim arose and the User became aware of the circumstances underlying the claim or would have become aware without gross negligence. Any damage claims according to section 7.4 above are excluded from the aforementioned statute of limitations.

9. Exemption from liability by the User

The User holds Clhub.art harmless from all claims made by other Users or third parties on the basis of or in connection with any content that the User stores, publishes and/or transmits, or any claims associated with the User's use of the Website, or due to violations by the User of the present Terms and Conditions or of any third party rights.

10. Tradmarks and other Intellectual Property Rights

All rights to the Website and the "Clhub.art" designations, in particular any trademarks, copyright, performance protection rights, license rights or other rights or comparable legal protections on the Website (except for any User content) are reserved exclusively to Clhub.art. No part of the Website may be used for commercial purposes without the prior written consent of Clhub.art.

11. Jurisdiction and Final Provisions

11.1. Any agreements and/or contracts between Clhub.art and the User shall be governed by the laws of the Federal Republic of Germany, under exclusion of the UN Convention on Contracts for the International Sale of Goods.

11.2. To the extent that it is permissible by law, all disputes shall fall under the jurisdiction of the Courts of Berlin, Germany.

11.3. Should one or more provisions in the contract be or become ineffective for factual or legal reasons, the effectiveness of the remaining contractual provisions will remain unaffected. In such a case, Clhub.art and the User shall agree to replace any ineffective provisions with provisions which are as close as possible to the original in their economic effects.

12. Members and Visitors of clhub.art platform commit to:

12.1. Provide up to date information on their profile about their contact and billing information.

12.2. Acknowledge that purchases are non-refundable except if the purchased artwork is no longer available at the time of the transaction, in this case the total of the transaction will be refunded to the buyer.

12.3. Take knowledge of the contents of the email, verbal or written notifications of changes to the terms and conditions informed by Clhub.art.

12.4. If purchasing an artwork which is currently in exhibition, pick up the artwork within 7 days after a purchase is processed. If this period cannot be met, inform the clhub.art team and coordinate with the clhub.art team for alternative pick-up or delivery.

12.5 Respect the means of delivery or deposit requested during the purchase:

By pickup at the Hub: Show the order number to the Hub responsible person for artworks. Sign the confirmation of receipt before leaving with the artwork. The buyer is responsible for checking the availability of the hub for the pick-up of the artwork beforehand, by telephone or in person.
By mail: No action required
By pickup at Club.art's service points : Appear in person with the order number or other means established by Clhub.art.

Be responsible for a purchased work from the moment it is delivered to them or from the moment it is picked up in a Hub.

The artworks displayed on the platform or in an establishment are not to be reproduced in any format without the written consent of the creators they belong to except for the purpose of online, offline and through all other form of media promotion, where only the photographs of the works in its context background clearly visible or photo of the work uploaded on Clhub.art accompanied by the name of the creator, the link to the Clhub.art exhibition, the link to the artwork's Clhub.art page or the link to the creator’s Clhub.art profile are allowed.

13. Clhub.art commits to:

13.1. Provide all possible support and means to accomplish activities around popup exhibitions to Hubs, Creators and Buyers.

13.2. Inform members of changes regarding Clhub.art’s services and policies.

13.3. Respect the agreements with all members around popup exhibitions according to the membership purchased by the member.

13.4. Offer its best efforts to ensure the respect of the means of delivery, shipping or deposit requested by the buyer when an artwork is sold on the platform or in a hub. Alternative means of delivery or pickup will be suggested by Clhub.art otherwise.

13.5. The artworks displayed on the platform or in an establishment are not to be reproduced in any format without the written consent of the creators they belong to except for the purpose of online, offline and through all other form of media promotion, where only the photographs of the works in its context background clearly visible or photo of the work uploaded on Clhub.art accompanied by the name of the creator, the link to the Clhub.art exhibition, the link to the artwork's Clhub.art page or the link to the creator’s Clhub.art profile are allowed.

Pop-up Exhibition

Glossary

Meaning of Hub: a member who has purchased a Monthly Pop-up Subscription or a Quarterly Pop-up Subscription. Location where the artworks are exhibited during the popup duration period.

Meaning of Creator: a member who has purchased a Creator Subscription (Free, Pro).

Meaning of Buyer: a user who purchases a product or service offered by a Creator, a Hub or Clhub.art team on clhub.art website.

Section 1: Hubs

Clhub.art's Hubs agree to:

Section 1.1: Hub profile and Open Call

1. Provide up to date information on their Hub profile about their business, walls availability, opening and closing time, walls dimensions.

2. Actively review open calls applications from creators to the Hub’s walls.

3. Provide their choice of artworks by following the process instructions of club.art's teams and platform. 

4. Take knowledge of the contents of the email, verbal or written notifications of changes to the terms and conditions informed by Clhub.art.

5. Provide a choice of artworks latest 3 days after the open call deadline.

6. If no artwork in the open calls application matches the wish of the Hub, provide feedback to clhub.art team via email latest 3 days after the open call deadline.

7. Inform Clhub.art of any changes related to the operations of the establishment that may influence the transactions and / or the agreement with Clhub.art such as the changes regarding business hours, owners / managers, contact information, website, etc.

8. Be courteous and friendly when interacting with Clhub.art's creators and clients..

Section 1.2: Pop-up exhibition

1. Reserve wall spaces listed on Clhub.art at no cost and only for works available on Clhub.art’s platforms.

2. Inform Clhub.art team via email (hello@clhub.art) if the Hub is not able to host exhibitions due to construction work. This must be done at least 15 days before the beginning of the next pop-up.

3. Inform Clhub.art team via email if the Hub is not able to host exhibitions due to a closing of at least 15 days. This must be done at least 15 days before the beginning of the next pop-up.

4. Use only Clhub.art platform for all communication with creators. Clhub.art aims to enable all communication, logistics and billing processes through its platform in order to centralise communications. Therefore it is not permitted to contact Clhub.art creators in the context and the process of pop-up with Clhub.art, apart from exceptions in which you have Clhub.art's agreement. If Clhub.art allows communications via other means, this is only for the temporary use according to a written agreement provided by Clhub.art and the Hub is not permitted to use the creator’s contact information temporarily provided for future personal or promotional ends.

5. Provide the necessary equipment to prepare the walls for a safe display of the artwork on the walls (nails, screws, hammer, etc.). Otherwise, the exhibitor agrees to pay fees for wall hardware such as nails, etc. provided by Clhub.art.
(The creator is only responsible for the preparation for display of the artwork, with the iron wire installed behind the canvas or frames if the artwork is a photograph.)

6. Respect the creators' work by prohibiting clients and staff from touching or moving the works except in the case of a post-sale, post-confirmation and post-signature transaction.

7. Respect the initial agreed display placement of an artwork during the 3-month display period to avoid confusions concerning the Clhub.art reference codes. Fees of 50 euros per artwork will be charged to the establishment for any change of location within the same business during the pop-up exhibition period. In the case of early cancellation of the display of an artwork by the establishment within the three-month contract, fees of 100 euros per artwork removed will be charged to the Hub.

8. The artworks displayed on the platform or in an establishment are not to be reproduced in any format without the written consent of the creators they belong to except for the purpose of online, offline and through all other form of media promotion, where only the photographs of the works in its context background clearly visible or photo of the work uploaded on Clhub.art accompanied by the name of the creator, the link to the Clhub.art pop-up, the link to the artwork's Clhub.art page or the link to the creator’s Clhub.art profile are allowed.

Section 1.3: Artwork Sale

1. Instruct visitors and customers to use the QR codes provided by Clhub.art for each artworks in case they wish to purchase the artworks or know more about it and its creator.

2. Confirm transactions when a purchase is made by calling one of Clhub.art’s managers with the transaction code that the client has received by email, then have them sign the confirmation of receipt in annex 1 before leaving with the painting. (The confirmation of receipt form must be kept by the Hub.)

3. Contact and notify Clhub.art of any problem related to transactions and contacts with the creators and customers by email (hello@clhub.art) or by phone. All sales of the displayed artwork must be made through clhub.art or will not be considered valid.

Section 2: Creators

Clhub.art's Creators agree to:

Section 2.1: Creator Profile

1. Provide up to date information on their Creator profile about their artworks, artworks location, artworks availability, prices.

2. Actively manage their profile by ensuring that all information, photos and availability of their artworks on Clhub.art’s platform are accurate and up-to-date.

3. All pictures uploaded to Clhub.art must not show defamatory, discriminatory or offensive content. Clhub.art team reserves the right and takes responsibility for deciding if content uploaded by the Creator is defamatory, discriminatory or offensive content. Clhub.art reserves the right to remove any of the defamatory, discriminatory or offensive content.
Clhub.art reserves the right to remove the picture or to remove the visibility of a picture, image or profile that does not meet the criteria mentioned above.
Clhub.art reserves the right to hide or delete, without notice any content that Clhub.art judges as defamatory or offensive, presenting any degree or nature of discrimination, racism, hatred, harassment, violence or harm against any individual or group, or promoting illegal or harmful activities, products or substances.

4. Take knowledge of the contents of the email, verbal or written notifications of changes to the terms and conditions informed by Clhub.art.

5. Respect the access to features given by her/his/their Clhub.art subscription.

6. Respect the commission fees on artworks sale given by her/his/their Clhub.art subscription.

Section 2.2: Pop-up exhibition

1. Reserve all artworks proposed in an open call application for Clhub.art at no cost.
     a. If an artwork is chosen then the creator reserves the artwork to Clhub.art use up until the end of the pop-up exhibition.
     b. If an artwork is not chosen, the reservation period ends.

2. Inform Clhub.art team via email (hello@clhub.art) if an artwork is damaged and could not be used for a pop-up exhibition.This must be done at least 15 days before the deadline of an open call.

3. Use only Clhub.art platform for all communication with Hubs. Clhub.art aims to enable all communication, logistics and billing processes through its platform in order to centralise communications.Therefore it is not permitted to contact Clhub.art Hubs in the context and the process of pop-up with Clhub.art, apart from exceptions in which you have Clhub.art's agreement. If Clhub.art allows communications via other means, this is only for the temporary use according to a written agreement provided by Clhub.art and the Creator is not permitted to use the hubs’ contact information temporarily provided for future personal or promotional ends.

4. Ensure that the status, the material and the quality of artworks proposed in the open call application are exactly in line with the text used to describe the artwork, its dimensions and materials used for the creation.

5. Acknowledge that a Hub can refuse an artwork if the status, material or dimensions do not match what the information about it says on Clhub.art’s online platform.

6. Make sure that their artwork is ready for display, (wire installed, frame, etc.) when brought to the exhibitor.

7. Organize together with clhub.art team the method to pick up the artworks after the end of a pop-up exhibition period.

Section 2.3: Artworks

1. By uploading an artwork to Clhub.art or proposing it when applying to an open call, the creator confirms that he/she/they is/are the original author of the work and owns/own all rights to broadcast the content.

2. Inform Clhub.art team via email and/or by changing the status of an artwork in case the artwork is not available anymore. 
   a. If the creator did not inform about the status change of the artwork (from available to not available) and the artwork is sold through Clhub.art, service
         charges and administration fees may be charged to the creator.

3. Agree with clhub.art on an installation date and time at latest 7 days before the established start of their exhibition.
If this period is exceeded, the hub is entitled to choose other artworks to host on their walls.

4. Redirect interested customers to the Clhub.art’s online platform.

5. Respect the initial agreed display placement of an artwork during the pop-up exhibition period to avoid confusions concerning the Clhub.art reference codes.

6. Be courteous and friendly when interacting with Hubs, Creators and clients.

7. Any sale of physically exhibited artwork during a pop-up exhibition must be processed through Clhub.art’s platform.

8. A creator cannot withdraw an artwork from a Hub during a pop-up exhibition period.
     a. Unless the creator pays Clhub.art the 30% value of the displayed price of the artwork.

     b. A physically displayed artwork in a Clhub.art's hub is automatically available for sale on Clhub.art platform.

9. A creator cannot change the price of an artwork during a pop-up exhibition period.

10. Any artwork added by the creator on Clhub.art platform and not shown in a pop-up exhibition can:
     a. Be subject to price changes. 

      b. Be removed from Clhub.art platform by informing Clhub.art team via email (hello@clhub.art) or via the platform, unless the artwork is sold via Clhub.art’s platform.

11. If an artwork is sold via Clhub.art platform, the creator has to make the work available to Clhub.art for delivery to the customer who made the purchase.

12. Clhub.art reserves the rights to evaluate each sale in order to define the most suitable solution for the delivery of artworks to buyers.

13. The available options for delivery to buyers are:
     a. By post: The creator is responsible for preparing the package according to instructions received from the Clhub.art team.

     b. By deposit to one of the Clhub.art Hubs available to receive the artwork: The creator is responsible for delivering the artwork to a Hub chosen by the Clhub.art team within the agreed date with the Clhub.art team. Clhub.art team is responsible to deliver the artwork to the buyer.

     c. By collect: The creator is responsible for preparing the package according to instructions received from the Clhub.art team. Clhub.art team is responsible for picking up the artwork at the location stated by the Creator.Clhub.art team is responsible to deliver the artwork to the buyer.In exceptional circumstances, the buyer could be the one responsible for picking up the artwork.

14. In case of delivery by post: inform Clhub.art team if he/she/they are not able to provide the artwork according to the given instructions for delivery.

15. In case of delivery by deposit: inform Clhub.art if he/she/they are not available at the agreed date, time and location of the deposit.

16. In case of delivery by collect: inform Clhub.art team if he/she/they are not available at the agreed date, time and location of the collecting.

17. Be responsible for insuring their artwork, as the hubs are not held responsible for any damages, theft or loss.

18. Notify Clhub.art team for any problem regarding transactions by email (hello@clhub.art).

19. Make sure to have the consignment agreement signed as a confirmation of receipt as proof of the deposit of their work for a physical display.

Section 3: Buyers

Clhub.art's Buyers agree to:

Section 3.1: Buyer

1. Provide up to date information on their profile about their contact and billing information.

2. Acknowledge that purchases are non-refundable except if the purchased artwork is no longer available at the time of the transaction, in this case the total of the transaction will be refunded to the buyer.

3. Take knowledge of the contents of the email, verbal or written notifications of changes to the terms and conditions informed by Clhub.art.

4. If purchasing an artwork which is currently in exhibition, pick up the artwork within 7 days after a purchase is processed. If this period cannot be met, inform the clhub.art team and coordinate with the clhub.art team for alternative pick-up or delivery.

5. Respect the means of delivery or deposit requested during the purchase:

     a. By pickup at the Hub: Show the order number to the Hub responsible person for artworks. Sign the confirmation of receipt before leaving with the artwork. The buyer is responsible for checking the availability of the hub for the pick-up of the artwork beforehand, by telephone or in person.

      b. By mail: No action required

     c. By pickup at Club.art's service points: Appear in person with the order number or other means established by Clhub.art.

6. Be responsible for a purchased work from the moment it is delivered to them or from the moment it is picked up in a Hub.

7. The artworks displayed on the platform or in an establishment are not to be reproduced in any format without the written consent of the creators they belong to except for the purpose of online, offline and through all other form of media promotion, where only the photographs of the works in its context background clearly visible or photo of the work uploaded on Clhub.art accompanied by the name of the creator, the link to the Clhub.art exhibition, the link to the artwork's Clhub.art page or the link to the creator’s Clhub.art profile are allowed.

Section 4: Clhub.art

Clhub.art commits to:

1. Provide all possible support and means to accomplish activities around popup exhibitions to Hubs, Creators and Buyers.

2. Inform members of changes regarding Clhub.art’s services and policies.

3. Respect the agreements with all members around popup exhibitions according to the membership purchased by the member.

4. Offer its best efforts to ensure the respect of the means of delivery, shipping or deposit requested by the buyer when an artwork is sold on the platform or in a hub. Alternative means of delivery or pickup will be suggested by Clhub.art otherwise.

5. The artworks displayed on the platform or in an establishment are not to be reproduced in any format without the written consent of the creators they belong to except for the purpose of online, offline and through all other form of media promotion, where only the photographs of the works in its context background clearly visible or photo of the work uploaded on Clhub.art accompanied by the name of the creator, the link to the Clhub.art exhibition, the link to the artwork's Clhub.art page or the link to the creator’s Clhub.art profile are allowed.
